The following terms and conditions are in place to ensure we maintain a safe and fair online Vice Vape Co ecommerce website.
Acceptance of Terms and Conditions
By registering as a customer of Vice Vape Co and a user of the Vice Vape Co website you accept these terms and conditions. Should you choose not to accept these terms and conditions, you are not permitted to use the Vice Vape Co website.
These Terms and Conditions have the following expressions and meanings:

Changes to Terms and Conditions
These terms and conditions may be changed from time to time. All changes will be effective immediately upon posting changes on the website. It is the responsibility of all Vice Vape Co customers to be familiar with the latest terms and conditions. Your on-going use of the Vice Vape Co website represents your agreement to these terms and conditions.
Health Warning
Smoking causes lung cancer, heart disease, emphysema, and may complicate pregnancy. Smoking by pregnant women may result in fetal injury, premature birth and low birth weight. Cigarette smoke contains carbon monoxide. Quitting smoking now greatly reduces serious risks to your health.
Warning
Purchasers of cigarette/tobacco must be at least 18 years of age. By selecting any of the product categories, you are legally confirming that you are 18 years of age or older. Purchases of tobacco products will also require proof of age upon delivery and we are obligated to not deliver these items otherwise.
Guarantees
If you buy a product from the Vice Vape Co website and receive a faulty product or a product different from that which you purchased, please contact us to arrange for your purchase to be returned for a full refund or credit. No refund will be given for product returned in an unsellable condition or for product not found to be faulty on inspection of the returned goods.
Price
All prices published on the Vice Vape Co website are in New Zealand dollars and include 15% Goods and Services Tax (GST). A courier fee will apply to all purchases made through the Vice Vape Co website. This fee is a flat charge of $5.00 for all non-rural deliveries nationwide, with a rural delivery fee of $10.00.
Confirmation of Order
All customers, including corporate customers, will receive an order confirmation via e-mail when placing an order through the Vice Vape Co website. Customers, following credit card payment, will also receive an invoice with their order.
Payment Terms
We accept payment for purchases made through the The Big S Management Limited website via Visa and Master Card credit cards only. All charges are made in New Zealand dollars and include GST. We charge your credit card at the time of your purchase via the DPS hosted secure (SSL) payment system.
Product Guarantee
All products are guaranteed free of any manufacturing defects for a period of 3 months for electrical components. In the event that you experience any product issues/problems please call us first and we’ll advise of the correct measures to remedy such problems. Our sole obligation will be to repair or replace any defective merchandise due to any manufacturing defects so long as the product has been correctly installed and complying with any Vice Vape Co recommendations. Vice Vape Co does not warrant damage resulting from misuse, incorrect installation or improper storage. Vice Vape Co is not liable for any incidental or consequential damage.
Delivery Policy
All goods are dispatched by courier within 48 hours unless stated otherwise on the website for a particular product. Delivery times vary from 1-5 days subject to location throughout New Zealand. If a product ordered is out of stock and on back order, Vice Vape Co will advise the customer via e-mail on receiving their order and of the expected wait time for the product.
Return / Cancellation Policy
Any claims against purchases from Vice Vape Co must be made within 7 days of delivery, except where the claim is for a product manufacturing defect which products are guaranteed free of for a period of 3 months for electrical components. Prior to returning goods all customers must first contact Vice Vape Co customer support and advise of the return of goods. All returned goods must be in the original packaging, undamaged, not used and accompanied with a copy of the invoice. In the event that a qualified Vice Vape Co technician finds no fault with the product, it may be returned to you at the discretion of Vice Vape Co with no refund provided.
All courier charges on returns are not refundable unless the return is due to a manufacturing defect, you receive goods different from that which you purchased or your goods are damaged in transit. If you do receive a product which is faulty or different from that which you purchased, please contact us immediately to arrange return of the product. Our qualified technician will then inspect the returned product and if found to be faulty or different from that which you purchased, you will be reimbursed for the delivery charge. For goods damaged in transit, Vice Vape Co may refuse to exchange these damaged goods if you signed for them at the time of delivery, accepting the goods were received in good condition. Please ensure you check your goods for any damage prior to signing the delivery docket for your product.
Your Account
By registering as a user of the Vice Vape Co website you warrant that you have provided complete, accurate and current personal or business information. You must maintain and update your information held by Vice Vape Co to ensure it is kept current at all times. Vice Vape Co may phone or mail you to verify these details. Without limiting any other rights or remedies we may have, you agree not to permit any other person to use your details or customer information for the purchase of goods through the Vice Vape Co website.
We may, at our discretion, monitor your use of the Vice Vape Co website and restrict access to any content or services available.
Emails, Newsletters and Product Reminders
Vice Vape Co may send you emails relating to products purchased, transactions and other activities on the website, and for promoting and marketing other Vice Vape Co product and services to you including new product lines or product specials on offer. Vice Vape Co may also send regular electronic newsletters to customers. Newsletters will contain clear and obvious instructions on how you can unsubscribe from the mailing list. You may also receive a reminder that your filter/cartridge is due for replacement. If you do not wish to receive these reminders , please contact us to have your name deleted from our recall/reminder list.
Indemnity
Except where we have expressly accepted responsibility to you under these Terms, you will keep us protected against any legal action taken against us and pay us any costs, losses or expenses we incur in connection with your use of our website or any failure by you to comply with these Terms.
Termination
We reserve the sole discretion, without notice, to terminate your account and ability to buy product or use our website services if we believe that you have breached these Terms and Conditions. We may also in our sole discretion and without notice to you, stop providing some or all of the product and/or services or the Vice Vape Co website as a whole. Any termination by us under this term will not affect any rights or responsibilities which are intended to continue, or come into force after that time.
Intellectual Property Rights
Vice Vape Co (and Vice Vape Co suppliers as the case may be) own all proprietary and intellectual property rights on and in the Vice Vape Co website (including text, content, graphics, logos, images, icons) and the software and architecture forming Vice Vape Co product, services and the website. You may not without our prior written permission, in any form or by any means copy, reproduce, adapt, display, distribute, publish or create derivative works from any part of the Vice Vape Co Website; or commercialise, copy, or on-sell any information, or items obtained from any part of the Vice Vape Co website.

Vice Vape Co accepts no liability for any damage to product or property in situations where water pressure exceeds 850kpa or 125psi or where Water Hammer is present and a pressure limiting device has not been installed.
General Terms
In the event of a dispute arising in relation to these Terms and Conditions, the New Zealand courts will have non-exclusive jurisdiction over such a dispute. If we do not exercise or enforce any right available to us under these Terms, this does not constitute a waiver by us of those rights. We may transfer this agreement or any benefit or obligation of this agreement to any person without notice to you. You may not transfer any benefit or obligation to any other person without our written consent. Each part of these Terms is separately binding. If for any reason any part cannot be relied on, all other parts remain binding.
Privacy Act 1993
If You are an individual, You have rights under the Privacy Act 1993 to access information held by Us, and to request the correction of such personal information. In respect of such personal information, You:
> Authorise Us to obtain personal information about You, via Your Registration Form and Your use of Vice Vape Co and Our Services.
> Authorise Us to use Your personal information for direct marketing and promotional activities, research and development purposes, identity verification, and otherwise in respect of the provision of Our Services to You.
> Agree that further notification to You of the purpose of the collection of Your personal information is unnecessary and non-compliance with the requirements of Principle 3 of the Privacy Act 1993 is authorised.
